Resumen
El objetivo de este ensayo es determinar el alcance de la expresión “descongestión judicial” en el marco de la conciliación preprocesal y extrajudicial en asunto de derecho de familia. Y así poder ver a la conciliación, como mecanismo alternativo de solución de conflictos, regulado por la jurisdicción colombiana, la cual ofrece un procedimiento ágil, fácil y seguro de cómo solucionar una controversia presentada en la sociedad. Esta herramienta es una de las mejores creaciones que se ha hecho y que si se utiliza de una forma adecuada la misma será efectiva.
La intención de este artículo es dar un enfoque amplio al lector de la importancia de la conciliación ya sea antes de iniciar el proceso (preprocesal), persuadiendo a las partes del conflicto en tomar la iniciativa de solucionar sus problemas a través de este mecanismo que y así evitar el desgaste de la administración de justicia o una vez iniciado hacerlo de manera (extrajudicial) para suspender el proceso en curso.
Este es un ensayo critico respecto de la expresión “descongestión judicial” a su vez es descriptivo y explicativo en cuanto que la idea es dar entender al lector la función tanto del conciliador como las partes en conflicto de que estas sean conscientes de la importancia de este mecanismo y no lo vean exclusivamente como un requisito para poder proceder a la administración de justicia, sino que por el contrario lo visualicen como realmente debe ser una herramienta facilitadora de darle solución a las diferentes problemáticas; en este caso en concreto con énfasis en el derecho de familia y poder ver los conflictos y controversias de una manera positiva.
Una vez desarrollando este ensayo podremos concluir que la conciliación es un gana gana desde todos los puntos de vista ya sea en una conciliación preprocesal o extrajudicial porque siempre las partes se verán beneficiadas y se evidenciara la descongestión judicial.
The objective of this essay is to determine the scope of the expression “judicial decongestion” within the framework of pre-procedural and extrajudicial conciliation in matters of family law. And thus to be able to see conciliation, as an alternative dispute resolution mechanism, regulated by the Colombian jurisdiction, which offers an agile, easy and safe procedure on how to solve a controversy presented in society. This tool is one of the best creations that has been made and if used properly it will be effective.
The intention of this article is to give a broad focus to the reader of the importance of conciliation either before starting the process (pre-procedural), persuading the parties to the conflict to take the initiative to solve their problems through this mechanism that and thus avoiding the wear and tear of the administration of justice or once started doing so in a (extrajudicial) way to suspend the ongoing process.
This is a critical essay regarding the expression "judicial decongestion" in turn is descriptive and explanatory in that the idea is to make the reader understand the role of both the conciliator and the parties in conflict that they are aware of the importance of this mechanism and do not see it exclusively as a requirement to be able to proceed with the administration of justice, but on the contrary, visualize it as a facilitating tool to solve the different problems; in this particular case with an emphasis on family law and being able to see conflicts and controversies in a positive way.
Once developing this essay, we can conclude that conciliation is a win-win from all points of view, whether in a pre-procedural or extrajudicial conciliation because the parties will always benefit and judicial decongestion will be evidenced.
