Abstract
El presente artículo procura analizar la situación actual de las interceptaciones telefónicas en Colombia en relación con la protección al derecho fundamental de la intimidad, siguiendo una metodología analítica reflexiva en el estudio de las principales sentencias emitidas por las altas cortes Colombianas y por tribunales de otros países acerca del objeto de estudio. La estructura del trabajo consta de 4 ejes temáticos objeto de análisis. El primero se orienta a establecer el tratamiento de las interceptaciones telefónicas bajo el sistema inquisitivo y acusatorio y la manera como ha sido tratada esta actividad judicial en nuestro país; el segundo eje determina la protección que ha sufrido el derecho fundamental a la intimidad en su reconocimiento tanto nacional como internacional especialmente en relación con las interceptaciones telefónicas; el tercero conceptualiza la figura del control previo de legalidad adoptado en el sistema acusatorio como garantía a la protección de los derechos fundamentales y finalmente el cuarto eje muestra como el juicio de proporcionalidad y necesidad previos a la realización de actuaciones como las interceptaciones telefónicas son menesteres para garantizar la protección de los derechos fundamentales. La conclusión muestra las interceptaciones telefónicas tal y como están concebidas en nuestro sistema judicial, como una actuación vulneradora del derecho a la intimidad, y al control previo de legalidad como una garantía mínima para la protección del mencionado derecho fundamental, planteando finalmente la implementación de este control para dichas actuaciones.
This article attempts to analyze the current situation of the wiretapping in Colombia regarding the protection of the fundamental right of privacy, following a thoughtful analytical methodology in the study of the main judgments of the high Colombian courts and courts in other countries about the object of study. The structure of the work consists of four main themes under analysis. The first aims to establish the treatment of wiretapping under the inquisitorial and adversarial system and the way it has been treated this judicial activity in our country. The second determines the protection that has been the fundamental right to privacy in both its domestic and international recognition especially with regard to the wiretapping. The third conceptualizes the figure of the previous control of legality in the adversarial system adopted to guarantee the protection of fundamental rights. Finally, the fourth shows how the test of proportionality and prior to performing actions such as wiretapping need are necessities to ensure the protection of fundamental rights. The conclusion shows that wiretapping are conceived in our judicial system, as a performance that violated the right to privacy, and prior judicial review as a minimum guarantee for the protection of the right referred vital, finally proposing the implementation of this Control over these actions.
