Resumen
Con la vigencia del Acto Legislativo 03 de 2002 y de la Ley 906 de 2004, se adopta un nuevo sistema de procedimiento penal. Este cambio aplicado a la justicia penal colombiana, es en opinión de algunos teóricos, junto a la promulgación de la Constitución de 1991, uno de los cambios de mayor injerencia en la realidad jurídica del país, debido a su complejidad y costos. Con la adopción de un nuevo modelo de justicia penal, se buscó dotarla de una mayor eficacia y reforzar garantías, sin embargo el resultado esperado no se realizó, dejando entrever deficiencias en el nuevo modelo procesal, que a juicio de los autores, imposibilita la realización de una justicia sustancial, haciendo un especial énfasis en el manejo que se le ha dado al testimonio, dentro de su dimensión práctica y valoración probatoria en el proceso penal. El presente artículo realiza un estudio reflexivo acerca del papel del testimonio como elemento, que si bien llega a considerarse prueba reina, en la naturaleza, proceso de recepción y de prueba, se ha convertido en un obstáculo para la realización de una justicia de características eficiente y eficaz, que vicia la percepción y creencia del usuario así como la del operador judicial. El presente texto realiza un estudio comparativo entre la concepción y funcionalidad del testimonio, su recepción, conservación y práctica, tanto en la ley 600 de 2000 como en la ley 906 de 2004, lo anterior con miras a establecer sus pros y contras, como elemento realizador de justicia.
With the implementation of Legislative Act 03 of 2002 and Act 906 of 2004, a new system of criminal procedure was adopted. This change applied to Colombian criminal justice, is in the opinion of some theorists, together with the promulgation of the 1991 Constitution, one of the most inherent changes in the legal reality of the country, due to its complexity and costs. With the adoption of a new model of criminal justice, it was intended to achieve more efficiency and strengthen guarantees; however the result was not fulfilled, suggesting deficiencies in the new process model by preventing the execution of substantial justice, with particular emphasis in management that has been given to the testimony, in its practical dimension and weighing of evidence in criminal proceedings. This article makes a thoughtful study of the role of testimony as an item that comes to be considered while showpiece in the nature and process of receiving and testing has become an obstacle to the realization of justice and efficient features effective, that taints the perception and belief of the user as well as the legal operator. This paper presents a comparative study between the design and functionality of the testimony, the receipt, retention and practice in Act 600 of 2000 and Act 906 of 2004 in order to establish their pros and cons, as an element in the justice execution.
